2. About the directory
Zero Wasters is an online directory intended to help people discover refill shops, zero-waste stores and other businesses offering relevant products, facilities or services.
The website provides information and links to independent businesses. Zero Wasters does not own, operate, manage or act as agent for the businesses listed in the directory unless expressly stated otherwise.
A listing appearing on Zero Wasters does not amount to an endorsement, recommendation, certification or guarantee of that business, its products or its services.
3. Eligibility and acceptable use
You may use the website only for lawful purposes and in accordance with these Terms and Conditions.
You must not:
- use the website in any unlawful, fraudulent, misleading or abusive way;
- submit information that you know is false, inaccurate or out of date;
- impersonate another person, business or organisation;
- submit a listing without proper authority where you claim to represent a business;
- upload malicious code, viruses or harmful files;
- attempt to gain unauthorised access to the website, accounts, servers or data;
- interfere with the operation, security or performance of the website;
- scrape, harvest or copy substantial parts of the directory by automated means without written permission;
- use information obtained through the website for spam, harassment or unlawful marketing;
- submit content that is defamatory, threatening, discriminatory, obscene or otherwise unlawful;
- infringe another person’s copyright, trade mark, privacy or other legal rights; or
- use the website in a way that could damage Zero Wasters, its users or listed businesses.
4. User accounts
Certain features may require a user account.
You are responsible for:
- providing accurate account information;
- keeping your login details and password secure;
- all activity carried out through your account; and
- telling us promptly if you believe your account has been accessed without permission.
You must not share an account in a way that compromises its security or use another person’s account without permission.
Where guest listing submission is enabled, the directory system may create an account using the email address supplied with the submission.
We may suspend, restrict or close an account where we reasonably believe that these Terms and Conditions have been breached, the account poses a security risk or the account is being used unlawfully or abusively.
5. Listing submissions
Listings may be submitted by business owners, authorised representatives, directory users or Zero Wasters.
By submitting or updating a listing, you confirm that:
- the information supplied is accurate to the best of your knowledge;
- you have authority to provide and publish the information;
- you have permission to upload any photographs, logos or other materials supplied;
- the listing does not infringe another person’s rights;
- the listing is not misleading, unlawful or inappropriate; and
- the contact details submitted are suitable for public display where applicable.
Submitting a listing does not guarantee that it will be accepted, published, retained or displayed in any particular position.
We may review, edit, categorise, correct, reject, suspend, merge or remove a listing where reasonably necessary to:
- improve clarity, consistency or accuracy;
- remove duplicate or outdated information;
- respond to a complaint or correction request;
- protect users or third parties;
- comply with the law; or
- enforce these Terms and Conditions.
6. Business information gathered from public sources
Zero Wasters may create or update listings using legitimate publicly available information, including information found on business websites, social-media pages, public directories, maps and other public sources.
Business owners or authorised representatives may contact us to request a correction, update or removal where appropriate.
Requests should be sent to mail@zerowasters.co.uk and should include enough information for us to identify the relevant listing.
7. Accuracy of listings
We aim to keep directory information useful and reasonably accurate, but business information can change without notice.
We do not guarantee that any listing is complete, accurate, current or free from errors.
Before travelling, purchasing or relying on a listing, you should confirm important details directly with the relevant business, including:
- opening hours;
- address and accessibility;
- products, refill options and services;
- prices and payment methods;
- stock availability;
- facilities; and
- contact information.
If you notice inaccurate or outdated information, please contact us so that it can be reviewed.
8. Deals with listed businesses
Any enquiry, visit, purchase, booking, agreement or other transaction between you and a listed business is between you and that business.
Zero Wasters is not a party to that transaction and is not responsible for:
- the quality, safety, legality or suitability of products or services;
- prices, payments, refunds or cancellations;
- availability or delivery;
- statements or promises made by the business;
- the conduct of a business, its staff or its customers; or
- any dispute arising between you and a listed business.
Your statutory rights against the relevant business are not affected.
9. Reviews, comments and user content
If the website allows reviews, comments, corrections or other user-generated content, you remain responsible for what you submit.
Content must be honest, relevant and based on genuine experience where it expresses an opinion about a business.
You must not submit content that:
- is knowingly false or misleading;
- contains unlawful allegations;
- is defamatory, abusive, threatening or discriminatory;
- reveals private personal information without permission;
- contains promotional spam or undisclosed advertising;
- infringes intellectual-property rights; or
- is otherwise unlawful or inappropriate.
We may moderate, refuse or remove user content where reasonably necessary, but we are not obliged to monitor every submission before publication.
10. Licence to use submitted content
You retain ownership of content that you submit.
By submitting content for publication, you grant Zero Wasters a non-exclusive, worldwide, royalty-free licence to:
- store, reproduce and publish the content;
- resize, format or make minor editorial changes;
- display it within listings, search results and promotional material relating to the directory; and
- retain reasonable records or backups.
This licence lasts for as long as reasonably necessary to operate the directory, maintain records and deal with disputes or legal obligations.
You confirm that you have the rights and permissions needed to grant this licence.
11. Intellectual property
The Zero Wasters name, branding, website design, original written content, software configuration and other materials created for the website are protected by intellectual-property law.
You may view and use the website for personal or legitimate business-directory purposes.
You must not reproduce, republish, sell, license or commercially exploit substantial parts of the website or directory without prior written permission, except where permitted by law.
Business names, logos, photographs and other materials belonging to listed businesses remain the property of their respective owners.
12. Third-party websites
The website may contain links to third-party websites, social-media pages, maps and services.
These links are provided for convenience. We do not control third-party websites and are not responsible for their content, availability, security, terms, privacy practices or services.
You access third-party websites at your own discretion and should review their terms and privacy information.
13. Website availability
We aim to keep Zero Wasters available and functioning properly, but we do not guarantee uninterrupted or error-free access.
We may suspend, withdraw, restrict or change all or part of the website where reasonably necessary for maintenance, security, technical, legal or operational reasons.
We may also change, discontinue or replace features without notice where this does not unfairly affect an existing contractual right.
14. Charges and paid services
Basic use of the directory may be provided without charge.
If paid listings, enhanced features, subscriptions, advertising or other paid services are introduced, the relevant price and any additional terms will be shown before an order or payment is made.
No payment obligation arises merely from viewing or using the free areas of the directory.
15. Security
You must not misuse the website by knowingly introducing malicious material or attempting to gain unauthorised access to the website, its server or connected systems.
We may report suspected criminal or unlawful activity to the appropriate authorities and cooperate with lawful investigations.
16. Our responsibility to you
Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so, including liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot legally be excluded or limited.
If you are using the website as a consumer, your statutory rights are not affected.
Subject to the paragraphs above, Zero Wasters is not responsible for loss or damage arising solely from:
- inaccurate, incomplete or outdated information supplied by a business, user or public source;
- your failure to verify information directly with a listed business;
- the acts or omissions of a listed business or third party;
- third-party websites or services;
- events outside our reasonable control; or
- use of the website in breach of these Terms and Conditions.
Where you use the website for business purposes, we are not responsible for indirect or consequential loss, loss of profit, loss of business, loss of opportunity or loss of anticipated savings, except where the law does not permit such an exclusion.
17. Indemnity for business and professional users
If you use the website in the course of a business and submit content or listings, you agree to compensate Zero Wasters for reasonable losses, liabilities, costs or claims arising directly from:
- content you submitted unlawfully;
- your infringement of another person’s intellectual-property or privacy rights;
- a material breach of these Terms and Conditions; or
- a false claim that you were authorised to represent a business.
This section does not apply to consumers acting wholly outside their trade, business, craft or profession.
18. Suspension and termination
We may suspend or terminate access to an account or particular website features where reasonably necessary because:
- these Terms and Conditions have been materially breached;
- fraudulent, unlawful or harmful activity is suspected;
- the security of the website or other users is at risk;
- a legal or regulatory obligation requires it; or
- an account has been abandoned or misused.
Where appropriate and reasonably practicable, we may provide notice or an opportunity to correct the problem.
19. Privacy and cookies
Our use of personal information is explained in our Privacy Policy.
Information about cookies and similar technologies is available in our Cookie Policy.
20. Changes to these Terms and Conditions
We may update these Terms and Conditions to reflect changes to the website, our services, legal requirements or business practices.
The updated terms will be published on this page and the “Last updated” date will be changed.
Where a change materially affects registered users or an existing paid service, we will take reasonable steps to provide appropriate notice.
21. Transfer of the website
We may transfer our rights and responsibilities relating to Zero Wasters to another organisation as part of a sale, transfer or reorganisation, provided this does not reduce your legal rights.
You may not transfer your rights under these Terms and Conditions to another person without our written agreement, except where the law permits otherwise.
22. Severability
If any part of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
23. No waiver
If we do not immediately enforce a provision of these Terms and Conditions, that does not mean that we have waived the right to enforce it later.
24. Governing law and jurisdiction
These Terms and Conditions are governed by the law of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory protections and rights available under the law applicable to you.
The courts of England and Wales will have jurisdiction, except where applicable consumer law allows you to bring proceedings in another part of the United Kingdom.
